Compliance & Labeling
By LuxoPacks Factory Team July 2026
Enactment, registration, reporting and fee collection happen on different schedules. A brand, importer or other party can be the responsible producer depending on the state and packaging layer, so determine that role before calculating obligations.
Begin with the states where products are sold or distributed, the packaging they cover and the producer definition. Then check exemptions and the current implementation schedule. A small-producer exemption can remove registration duties in one state while requiring an application in another.
Scope of this guide: The links below point to the relevant public authorities. Keep a dated applicability record for each state and use the current program instructions for filings and fees. Packaging EPR and import duties are separate obligations.
What packaging EPR is, and why a DTC brand is suddenly a "producer"
Treat EPR as an applicability and reporting question before treating it as a fee calculation. Establish which entity and packaging are covered under the relevant state program. A packaging supplier can supply material data, but that does not decide a brand’s producer status or exemption.
For a brand, the key question is which business is responsible for each packaging layer. The brand owner often has obligations, but importer, distribution and remote-shipping rules can change the answer. List the outer shipper, product box, insert, tissue, tape and other components, then classify their coverage under the relevant program.
State programs to check for your selling markets
Review the listed state programs separately and retain the dated official sources below. Enactment, reporting, registration and fee commencement are different milestones. Do not treat a future implementation date as a current bill or transfer an exemption from one state to another.
- Maine: Review Maine DEP's packaging stewardship program for implementation and producer guidance.
- Oregon: Check DEQ's producer exemption guidance before assuming registration is required.
- California: Use CalRecycle's SB 54 program and its exemption process.
- Colorado: The Producer Responsibility Program for Recycling establishes the program; obtain the applicable current reporting and fee instructions from the regulator or approved PRO.
- Minnesota: Follow MPCA's implementation work and the requirements that apply to your reporting period.
- Maryland: Consult MDE's producer responsibility program for its registration and implementation instructions.
- Washington: The Recycling Reform Act has staged implementation. Check the current producer milestones rather than importing another state's dates.
Review other destination states as well; this is a coverage checklist for the seven programs discussed here, not a claim that no other law can apply.
Small-producer exemptions: check the test and the procedure
Revenue and material thresholds use specific definitions and reporting periods. Read the complete criteria, including any related-entity or product-category provisions, before claiming an exemption.
| State | Verified starting point | Registration or evidence check |
|---|---|---|
| California | Gross annual sales below $1 million can qualify for a small-producer exemption | Register in PEPRS, then apply; an exemption does not remove every long-term obligation |
| Oregon | Less than $5 million gross revenue for the most recent fiscal year or less than one metric ton of covered products sold into Oregon in the most recent calendar year are two qualifying routes | Qualifying small producers need not register with a PRO, report supply or pay PRO fees; retain the evidence supporting the status |
| Colorado | Confirm the current statutory criteria and any applicable adjustments | Do not use a rounded $500,000 figure as an unverified eligibility decision |
| Maine / Minnesota / Maryland / Washington | Read each program's definitions, exemptions and effective dates | Confirm whether an application, notice or retained record is required |
California's application requirement is explained by CalRecycle. Oregon's exemption is materially different: DEQ states that qualifying small producers are exempt from PRO registration, reporting and fees, while ORS 459A.863(32) defines the routes to small-producer status. Do not turn an or test into an and test.
Registration deadlines and the California SB 54 timeline
Maintain separate entries for program registration, PRO membership, supply reporting, exemption applications and fee payment. These can have different recipients and deadlines even within one state.
For California, use the current CalRecycle SB 54 program updates and instructions for your compliance route. Distinguish registration from exemption applications, reporting and fees; use the deadline and status applicable to your business rather than an undated summary.
Record the source link, date checked, responsible staff member and next action in your compliance calendar. If a milestone has already passed, ask the program how to resolve the applicable obligation.
What data you have to report (packaging types and weights)
EPR reporting is a materials inventory. Programs generally want to know what packaging you put into the state and how much of it, broken out by material type and weight. In practice that means building a line-item list of every packaging component you ship and the weight of each.
This is where a lot of brands realize they've never actually weighed their packaging. You'll typically need the material and grams for your shipper box, your printed rigid or folding carton, any tissue or crinkle fill, the tape, the polybag or mailer, inserts and labels — component by component. If you don't have this on file, your packaging maker does. When you order from a factory, you can ask for a component-level spec sheet: material composition and unit weight for each part of the pack. That sheet becomes the backbone of your EPR reporting, so it's worth requesting up front rather than reverse-engineering it later.
Outer shipper
Corrugated grade and unit weight of the mailer or ship box.
Primary box
Board type and weight of the printed rigid or folding carton.
Void fill
Tissue, paper crinkle or other fill, by material and grams.
Tape & labels
Adhesive tape and label stock — small, but reportable.
How EPR fees actually hit per box, and how eco-modulation rewards recyclable formats
Fee calculations depend on the program, material category, reported supply, fee period and any applicable adjustments or minimum charges. For budgeting, multiply the measured weight or other required quantity by the current applicable rate, then include adjustments and fixed charges. A single cents-per-box figure is not portable across materials or states.
Some programs use fee adjustments to encourage better packaging design. Review the applicable methodology before assuming a paper-only construction or a removable component earns a lower rate. Compare complete material specifications, measured weights and local recovery requirements; FSC sourcing certification is a separate consideration.
Penalties for non-compliance, and why single-location sellers are still in scope
Non-compliance can lead to enforcement and penalties under the applicable state law. The consequence depends on the provision, violation and enforcement process; do not apply one headline daily maximum to every program or every filing error.
A single warehouse or business address does not determine EPR status. Sales into a state may be relevant, but the actual producer definition, covered material, exemption and implementation date decide the obligation. Check those elements rather than assuming either automatic liability or automatic exemption.

A practical readiness checklist before you register
- Map the selling markets. Identify the states receiving your products and relevant packaging.
- Identify the producer. Review the responsible party separately for product packaging and shipping packaging where the law distinguishes them.
- Check exemption criteria. Use the correct entity, revenue definition, material quantity and reporting period.
- Check the exemption procedure. Determine whether registration, an application or simply supporting records are required.
- Build the materials inventory. Record components, material categories, unit weights and quantities supplied.
- Set the deadlines and budget. Use each program's actual filing dates and current fee methodology.
- Keep the evidence current. Retain calculations, supplier specifications and dated agency guidance, and revisit them when the product or business changes.
This process gives the packaging supplier a clear data request while keeping the brand's legal and reporting decisions with its responsible team.
Frequently Asked Questions
Which state packaging EPR programs should I review?
This guide covers Maine, Oregon, California, Colorado, Minnesota, Maryland and Washington. Review each destination state's current rules as part of your own applicability assessment; program enactment and fee collection do not necessarily happen together.
Am I exempt as a small business?
Possibly. The relevant revenue, material-volume and other tests differ by state. Evaluate the complete definition and retain the calculations supporting your conclusion.
Must an exempt business still register?
There is no national answer. California requires registration and an application for its small-producer exemption, while Oregon's qualifying small producers are exempt from PRO registration, supply reporting and fees. Follow the procedure for the state concerned.
How much will EPR add to each box?
Use the current rate schedule with the material categories and quantities required by the program. Include adjustments and fixed charges rather than relying on a generic per-box estimate.
Is packaging EPR the same as import duty?
No. Import charges concern cross-border entry. Packaging EPR concerns responsibility for covered products and materials supplied into a regulated market. Track both in the budget, using their separate rules.
